Introduction
These Terms and Conditions, as may be modified and amended from time to time, sets forth the legally binding agreement by and between:

(b) a person or entity (“You”) that enters and uses the TourlaCappadocia marketplace platform accessible via the www.tourlacappadocia.com website and subdomains (the “Site”) to search for and/or book sightseeing tours and activities and other related services (the “Experiences”), and/or participates in activities booked through TourlaCappadocia and/or the Site.
1. Acceptance of These Terms and Conditions.
You hereby represent and warrant that:
(a) You have read, understand, and agree to comply with and be bound by these Terms and Conditions;
(b) You are an individual at least 18 years old or a duly organized, validly existing business, organization or other legal entity in good standing under the laws of the country in which You are established;
(c) You are able to enter into legally binding contracts;
(d) You are not forbidden by TourlaCappadocia to access and/or use the Site; and
(e) If you take additional participants to your Activity, You agree and warrant that the participants, or their legal guardians, have read and agreed to these Terms and Conditions, including, but not limited to, the Acceptance or Risk and Waiver Liability, Disclaimer, Limitation of Liability and Your Liability and Indemnification sections, which apply to all participants, as if the term “You” was a reference to the participants.
If You do not agree to be bound by these Terms and Conditions, You may not access and/or use the Site, and should not participate in an Activity.
These Terms and Conditions should be read together with the Cancellation Policy and Privacy Policy, as they are incorporated by reference into these Terms and Conditions.
2. Scope of TourlaCappadocia Services.
We operate the Site Tourla Cappadocia, which is a platform that connects travelers with carefully curated tours, activities, and local experiences offered by top-notch professionals in Cappadocia. We do not directly organize all tours and activities ourselves, but we work closely with reputable local partners to ensure exceptional experiences for our customers., and You to search and book Activities, post reviews, and process payments.
We are constantly updating our Site and its functionalities. Therefore, We may modify and/or delete any functionality on the Site and/or introduce new ones from time to time.
3. User Account
You may search for Activities and Experiences through the Site without prior registration. In order to book Activities on the Site, You may be required to register to open an account and complete your profile with your personal details (User’s Account). You shall not apply to open more than one User’s Account on the Site. The opening of a Traveler’s Account is at the sole discretion of TourlaCappadocia. We reserve the right to refuse to open a Traveler’s Account and/or cancel a Traveler’s Account without notice and liability, at our sole discretion, for any reason or for no reason. You must provide accurate, current and complete information and keep the information on your Traveler’s Account up-to-date at all times. We will only collect and use personal information from You in accordance with.
4. Privacy Policy
You are solely and exclusively responsible for any claims relating to any inaccurate, untimely or incomplete information provided by You. You are responsible for any activity on your Traveler’s Account, and shall keep your password confidential. If You are aware that any person has entered your Traveler’s Account without your permission, You shall inform TourlaCappadocia as soon as possible. Please refer to our separate Privacy Policy for information regarding collecting, using, and disclosing your personal information.
5. Booking and Payment
We may change the Activity prices without prior notice until a booking has been made. Activity Prices include all taxes. You will make payment of bookings by credit card or other form of payment available through the Site. We do not store credit card information. TourlaCappadocia uses a third party service to process your payment information for all transactions made through TourlaCappadocia. You authorize TourlaCappadocia and its payment service partners to process your payments. These payment processing services are governed by the terms and conditions of those third party services and will apply to the payments You make through their system. Prices are listed on the website and may vary depending on the chosen experience and date. We reserve the right to modify prices without prior notice. However, the price you book at will be the final price you pay.
6. Your Reviews
You may have access to post experiences' ratings and reviews (“Reviews”) and we may respond to such Reviews. By uploading, posting or otherwise making available your Reviews on or through the Site, You:
(a) Grant to Us a non-exclusive, worldwide, royalty-free, irrevocable, perpetual (or for the term of the protection), sub-licensable and transferable license to your Reviews to access, use, reproduce, display, perform, adapt, create derivative works, modify, distribute, and promote your Reviews in any form, anywhere, in connection with TourlaCappadocia’ business, without your prior approval and/or notification. This license shall survive termination of your Traveler’s Account on the Site.
(b) Warrant and represent that You own or otherwise control all of the rights to your Reviews and that use of your Reviews by TourlaCappadocia does not violate the rights of any third party;
(c) In the event that your Reviews provided by You to TourlaCappadocia violates the rights of a third party, You agree to indemnify TourlaCappadocia against any losses and liabilities that may result from the action of such third party against TourlaCappadocia;
(d) Understand that other users of the Site will access your Reviews.
You will not upload, publish, and/or send any Review that: (i) is fraudulent, false, or misleading; (ii) is defamatory, obscene, vulgar or offensive; (iii) promotes discrimination, bigotry, racism, hatred, harassment or harm against any Supplier and/or user; (iv) promotes illegal or harmful activities, or (v) includes contact details.
We reserve the right to remove or modify, without prior notice, any Reviews alleged to infringe any intellectual property rights, or that violate these Terms and Conditions, and/or unpublish any Activities containing such Reviews.
Reviews reflect the opinions of the users of the Site and do not reflect the opinion of TourlaCappadocia. TourlaCappadocia may verify Reviews for accuracy but does not warrant they are correct or accurate. TourlaCappadocia shall have no liability for Reviews or for any claims resulting from such Reviews.
7. Cancellations and Refunds
You can cancel most tours, activities, and local experiences up to 24 hours before the scheduled start time for a full refund. Cancellations with less than 24 hours' notice may be subject to a cancellation fee as determined by our local partners. Hot Air Balloon Rides may be canceled due to dependence on weather conditions; hot air balloon rides are subject to cancellation by the Turkish Civil Aviation Authority. In case of a cancellation, we will work diligently to reschedule your flight for the next available date. If rescheduling is not possible, you will receive a full refund. You can also cancel your hot air balloon reservation 24 hours before the flight for a full refund. Cancellations within 24 hours may be subject to a partial refund as determined by the hot air balloon operator.
8. Changes and Updates
Due to unforeseen circumstances, we reserve the right to modify the itinerary or schedule of a tour, activity, or local experience. We will make all reasonable efforts to notify you of any such changes in advance.
9. Acceptance of Risk and Waiver of Liability.
We urge You to obtain suitable medical insurance before taking a Tour. You acknowledge that all travel involves an element of risk. Also, some Activities may be adventurous in nature and may involve a significant amount of personal risk. We encourage You to ask for information and fully educate yourself about any risks, skills and level of fitness inherent to the tour.
You hereby assume all such risk, and You, your estate, your family, heirs and assigns hereby agree to release and hold harmless Tourla Cappadocia, its parent, subsidiaries, affiliates, directors, and employees (“ATA BALONCULUK TURİZM LİMİTED ŞİRKETİ,”) from all liabilities and claims that arise from damages of every kind and nature, known and unknown, both pecuniary and non-pecuniary, including but not limited to, illness, bodily injury, disability and death to You and/or any other Tour participant, that may arise out of, or in connection with, the participation in a Tour.
If you take a minor to a Tour, You agree to be legally authorized to act on behalf of the minor. Also, You are solely liable for the safekeeping and supervision of the minor at all times during the Tour.
10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Turkey.
